Labor and Delivery Errors Lawyer

During labor and delivery obstetrical nurses are responsible for evaluating the mother’s vital signs, the progress of labor, fetal heart tones and communicating with the obstetrician. If the nurse fails to identify fetal or maternal distress or the physician does not act appropriately given what the nurse is communicating, the consequences can be disastrous. The physician is also responsible for monitoring the mother throughout her prenatal checks to insure that any warning signs of potential problems are identified.

A baby can suffer an injury to it’s brain or cerebral palsy as a result of negligence during labor and delivery. This could be due to the failure to recognize fetal distress as recorded on the fetal heart monitor, the misuse of delivery instrumentation such as forceps or vacuum extractors, or even the failure to diagnose and treat prenatal infections.

While not all brain injuries or birth injuries are the result of negligent care, a review of the records by our legal nurse consultant and expert physicians may give you an answer as to whether the injury could have been avoided and whether a legal claim may be appropriate.
