How Do I Know If My Doctor Has Been Sued Before?

When I meet with clients for the first time, one of the questions that I typically get asked is whether or not I can tell them if their doctor has had any claims filed against them in the past. And the other information they would like to know is whether or not those claims were successful. This is information that isn’t just available to me. It’s also available to you. Go into in.gov/idoi. Once you get into the website, on the left, you’ll see the words, medical malpractice. Click on that medical malpractice, then one of the options that you will have, on the right, says, Indiana Patient’s Compensation Database, and it will then take you to a screen where you’re given two different options. One is to search for claims, the second is search for providers. You will want to go into search for providers.

At that point, you can then type in the name of your physician. You will then click on the screen, and it will list each and every claim that has ever been brought against that provider. You will also be able to see information such as whether the claim was paid into the patient’s compensation fund, whether the claim was dismissed, and again, the number of times that any suit has been brought against that healthcare provider.

You may find that your doctor has never had a claim brought against them, or you may also find that there have been several claims. The reality is, is that each claim should be judged on its own merits.
